  • As well as medical reimbursement, a larger part of the compensation could be loss of earnings up to the date of the court case and actuarialised up to 65 years of age (if the client is deemed medically to be unable to work in the future or to be unable to work full time in the future because of the accident).

Whiplash Claims Process & Fee Structure

You will find our service for motor injury claims a little more personal to meet your needs. We hope the following answers some of your questions about the process should you make a motor injury claim as well as particulars of the charges involved.

  • We submit your application to the Personal Injuries Assessment Board (PIAB), the first step in all personal injuries cases.
  • We pay the €50 application fee to the PIAB.
  • We obtain a medical report from your treating doctor necessary for outlining the injuries suffered by you in your accident together with all medical notes.
  • We pay for the medical report, which costs between €200 and €400.
  • The case shall be assessed by the PIAB and normally an offer is made to settle your case.
  • We advise fully on any offer made by the PIAB.
  • If you decide to accept the offer made by the PIAB, our total fee is €1,950 plus VAT for the work done to this point.
  • If you decide to reject the offer made by the PIAB we will issue Court proceedings on your behalf.
  • We pay all stamp duty on your court documents, which range from €300 to €500.
  • We update your medical reports where necessary and pay for these reports, which cost between €200 and €400 each.
  • We advise on any offers made by the Defendant.
  • We prepare and organise the hearing of your case before the Circuit Court or the High Court.
  • We ensure that your case proceeds as quickly and efficiently as possible.
Upon the successful completion of your case, the only fee payable by you shall be the amount mentioned above. All other fees shall be paid by the Defendant’s Insurance Company

Whiplash Symptoms

Symptoms of whiplash can occur immediately following an accident or minutes or even hours after the injury but are often not felt until days afterwards. Symptoms include;

  • Neck Pain
  • Neck swelling
  • Tenderness along the back of your neck
  • Muscle spasms (in the back or side of your neck)
  • Difficulty moving your neck around
  • Headache
  • Pain shooting from your neck into either shoulder or your arms
  • Sensory disturbances (such as ‘pins and needles’ and blurred vision)
  • Fatigue
  • Nausea
  • Dizziness
